MARINERS BASEBALL BINGO

Official Contest Rules

1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPACT YOUR OPPORTUNITY TO WIN. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

2. SPONSOR. Mariners Baseball Bingo ("Bingo") is sponsored solely by The Baseball Club of Seattle, LLLP (“Seattle Mariners,” "Mariners," or "Sponsor"), a Washington limited liability limited partnership, located at 1250 1st Ave S, Seattle, Washington, 98134.

3. ELIGIBILITY. Bingo (also the “Contest” herein) is open only to legal residents of the United States (including its commonwealths, territories, and possessions) and Canada (excluding the Province of Quebec) who are twenty-one (21) years of age or older at the time of entry. Employees and officers of Sponsor, the other MLB Entities (defined below), and each of their respective parent companies, subsidiaries, affiliates, advertising agencies, authorized dealers, promotional suppliers and prize providers (collectively, "Bingo Entities") and the immediate family members (spouses, parents, children and siblings and their spouses) or members of the same household (whether related or not) of such individuals are not eligible to enter or win. Void where prohibited. The "MLB Entities" shall mean the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLB"), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs ("Clubs"), each of their respective parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. Bingo is subject to all applicable federal, state, territory, provincial, and local laws, rules, and regulations. Void in the Province of Quebec and where prohibited or restricted by law, rule, or regulation.

4. ENTRY PERIOD. The Contest will be conducted during 2024 Seattle Mariners regular season home games (each, a “Game”) played between August 6, 2024 and September 29, 2024 (the "Contest Period"). The Contest Period will be divided into two (2) separate entry periods (each, an "Entry Period"), as follows:

Each Game during the applicable Entry Period begins with the first pitch at the top of the first (1st) inning of the Game and ends with the final out of the last inning of that Game.

5. HOW TO PARTICIPATE. To participate in Bingo, you must download the MLB Ballpark application available on the Apple App Store and Google Play (the "Application") to your personal mobile device. Once the Application is downloaded to your personal device, you must navigate to the Mariners page and click on the "Mariners Baseball Bingo" button to participate. Once you click the "Mariners Baseball Bingo" button, a randomly generated electronic Bingo game board for the applicable Entry Period will appear on the screen of your mobile device. Events will automatically check off on your Bingo game board as they occur on the playing field as determined by the authorized scorer (each, a "Game Event"). Participants are encouraged to hit "refresh" at any time to make sure they did not miss a Game Event. You may participate in Bingo only via the Application using your mobile device. No other method of entry will be accepted. Use of the Application to participate in Bingo is subject to, and will be treated in a manner consistent with, Major League Baseball's website (MLB.com) Terms of Use accessible at: https://www.mlb.com/apps/ballpark and https://www.mlb.com/official-information/terms-of-use. Standard message and data rates apply in accordance with your individual mobile service plan. Please consult your plan prior to entering.

6. WINNER DETERMINATION: There are three (3) ways to win: Single Bingo, the letter "M" and Blackout Bingo (each, a "Winning Event").

· SINGLE BINGO- Five (5) Game Events marked off in a row, in a column, or diagonally.

· LETTER "M" - Game Events marked off such that they form the letter "M" across the entire Bingo game board.

· BLACKOUT - All of the Game Events on the Bingo game board are marked off.

Upon a Winning Event, a Bingo button in the Application will begin to pulse and you must click on the button in order to submit your Bingo game board as a potential winning entry. YOU MUST HIT THE PULSING BUTTON (SINGLE, THE LETTER "M", AND BLACKOUT) IN ORDER TO WIN.

For each Entry Period,

  • Each participant to hit the pulsing button during such Entry Period for a "Single" Bingo will be a potential Entry Period Single Winner and, subject to verification of eligibility and compliance with these Official Rules, the potential Entry Period single winners will be declared the official Entry Period single winners (each, an "Entry Period Single Winner");
  • The first ten (10) participants to hit the pulsing button (depending on date/time stamp) during such Entry Period for a letter "M" Bingo will be potential M winners and, subject to verification of eligibility and compliance with these Official Rules, the potential M winners will be declared the official M winners (each, a "M Winner"); and
  • The first participant to hit the pulsing button (depending on date/time stamp) during such Entry Period for a "Blackout" Bingo will be the potential blackout winner and, subject to verification of eligibility and compliance with these Official Rules, the potential blackout winner will be declared the official blackout winner (the "Blackout Winner").

For each Entry Period, the four (4) participants who accumulated the most Bingo Points through winning Single Bingo, M Bingo and Blackout Bingo during the Entry Period, and one (1) randomly selected participant will be potential Entry Period winners and, subject to verification of eligibility and compliance with these Official Rules, the potential Entry Period winners will be declared the official Entry Period winner (each, an "Entry Period Winner"). In the event of a tie, prizes will be awarded to potential winners who have not won a Monthly Single Prize previously during the Contest Period. If a further tie-breaker is needed, the potential monthly single winner(s) who achieved Single Bingo during the latest Entry Period of the respective Month will be selected (and if both did so during such Entry Period, the potential winner(s) who did so first during such Entry Period will be selected).

See Rule 7, below, for descriptions of all available prizes.

7. GAME POINTS, PRIZES, PRIZE CONDITIONS AND ODDS. Points will be awarded per Game (“Points”) and prizes will be awarded per Entry Period and as set forth below (each, a "Prize" and collectively, the "Prizes"). The Single Bingo, Letter “M” and Blackout Points depends on whether Game Events happen and whether a randomly generated Bingo game board results in a Winning Event.

  • SINGLE BINGO Points: Each Single Bingo winner during each Game will receive one hundred (100) Bingo points.
  • LETTER “M” Points: Up to ten (10) M winners will be awarded per Game. Each M winner will receive two hundred fifty (250) Bingo points.
  • BLACKOUT Points. Up to one (1) Blackout winner will be awarded per Entry Period. The Blackout winner will receive five hundred (500) Bingo points.
  • ENTRY PERIOD PRIZES: Five Entry Period Prizes will be awarded per Entry Period for a total of ten (10) Entry Period Prizes. Each Entry Period Prize Winner will receive either (i) one (1) Mariners gift card, OR (ii) four (4) ticket vouchers for winner and three (3) guests to an upcoming Monday – Thursday 2024 Mariners regular season home game at T-Mobile Park at Sponsor’s sole discretion, OR (iii) one (1) autographed piece of Mariners merchandise signed by one (1) Mariners player or coach determined by Sponsor in its sole discretion; with the prize for each Entry Period determined by Sponsor in its sole discretion (each, an “Entry Period Prize”). Approximate retail value ("ARV") of each Entry Period Prize: between $50 and $100. TRANSPORTATION AND LODGING NOT INCLUDED.

Maximum ARV of all prizes awarded: up to $1,000.

All Prize details shall be determined in the sole discretion of Sponsor. Actual value of autographed items is subject to market fluctuations. No Certificate of Authenticity is provided by Sponsor. Items are not game-used. Except as determined by Sponsor in its sole discretion, no substitution of any Prize is offered, no transfer of any Prize to a third party is permitted, and no Prize may be redeemed for cash value. Any difference between stated ARV of a Prize and actual value of such Prize will not be awarded. Sponsor reserves the right to substitute the Prize (or any portion thereof) with a prize of equal or greater value at its sole discretion. Limit four (4) Prizes per person per Entry Period; provided, however, each person may only win one (1) of each of the four (4) Prize types per Entry Period. Released Parties (a) make no warranty, guaranty or representation of any kind concerning any Prize (or any portion thereof), and (b) disclaim any implied warranty.

Each Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All costs and expenses associated with the Prize acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of each individual Winner. TRANSPORTATION TO/FROM T-MOBILE PARK AND LODGING NOT INCLUDED WITH ANY ENTRY PERIOD FIRST PRIZE TICKETS. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see mariners.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Winner’s guest(s) must be of legal age of majority in his/her(their) jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Winner and his/her guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the prize; see brewers.com/ballpark for details. Sponsor and the other MLB Entities reserve the right to remove or to deny entry to the winner and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture and may invalidate the license granted by the game/event/exhibition ticket. Participation in the prize event is subject to winner’s (and guest’s) consent to and compliance with all health and safety policies of the MLB Entities, including but not limited to the wearing of masks if and when directed and the requirement to be fully vaccinated against COVID-19 (i.e., having received a final vaccination dose at least 14 days prior to the event).

Odds of winning an Entry Period First Prize, Entry Period Single Prize, M Prize or Blackout Prize during an Entry Period depend on the order and type of Game Events to happen during the applicable Entry Period, the makeup of your Bingo game board, and the placement of the Game Events on your Bingo game board for such Entry Period. Awarding of the above prizes is thus not guaranteed for every Entry Period. Odds of winning a Monthly Single Prize depend on the order and type of Game Events to happen during each Entry Period in which you participate during the applicable Month, the makeup of your Bingo game board for each Entry Period in which you participate, and the placement of the Game Events on your Bingo game board for each such Entry Period in which you participate. All Entry Period Single Prizes, M Prizes and Blackout Prizes accumulated during one (1) Month do not carryover to any subsequent Month (understanding that September and October together are deemed to be one (1) Month).

8. WINNER SELECTION AND NOTIFICATION. The Application will automatically notify you if you are a potential winner. Follow the instructions appearing in the Application prize notification to claim your Prize as directed and within the time frame noted in such prize notification. If you are an Entry Period Prize Winner, the Sponsor will contact you within fourteen (14) days of the end of the respective Entry Period to confirm your eligibility for an Entry Period Prize.

Each entrant is responsible for monitoring his/her Application for prize notification and receipt of other communications related to Bingo. If a potential winner does not claim his/her Prize during the time frame noted in the prize notification or above, as applicable, that potential winner forfeits his/her Prize. Upon request of Sponsor, a potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form in a form provided by Sponsor. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified and Sponsor, in its sole discretion, may select, as an alternate potential winner, the individual who achieves the applicable Winning Event after the applicable cut-off number noted above (e.g., if a potential M Winner is disqualified, the eleventh [11th] individual whose Bingo board results in a M Winning Event may be selected as an alternate potential M Winner). Fewer than the number of Prizes noted above may be awarded for an Entry Period depending on the number of Winning Events that occur during an Entry Period.

In no event will Sponsor be required to award more than the number of prizes stated in these Official Rules.

9. CONDITIONS OF PARTICIPATION. Bingo is subject to all federal, state and local laws and regulations and is void where prohibited. All other expenses on the receipt and use of a Prize not specifically mentioned in these Official Rules are solely the responsibility of each individual winner. By participating in Bingo, each entrant agrees (a) to accept and abide by these Official Rules and terms of use of the Application, (b) that any dispute with regard to the conduct of Bingo, rule interpretation or award of Prizes shall be submitted to the management of Sponsor, who will make a final, binding determination, and (c) to waive any and all claims against the Bingo Entities, Apple, Inc., and the licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the foregoing entities (collectively, "Released Parties") for any injury, damage or loss of any kind that may occur, directly or indirectly, in whole or in part, from participation in Bingo or from receipt or use of any Bingo Prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)). Each winner, by acceptance of a Prize, grants to MLB and Sponsor and each of their respective designees the right to publicize his/her name, address (city and state of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional and/or trade and/or any other purpose ("Winner Information") in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law. The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. ARBITRATION; CLASS ACTION WAIVER: As a condition of entering this Contest, each Participant agrees that (a) any and all disputes, claims, controversies, or causes of action arising out of or relating to this Contest or any Prizes awarded (each, a "Claim") shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party and (ii) settled by binding arbitration in Seattle, Washington before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circ*mstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses. For New Jersey residents, the limitations set forth above may be inapplicable where attorneys' fees, court costs, or other damages are mandated by statute. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of Washington, U.S.A, applicable to contracts entered into and performed exclusively in that State.

11. DISQUALIFICATION. Failure to comply with these Official Rules may result in disqualification. Sponsor and MLB reserve the right at their sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of Bingo; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH BINGO OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF BINGO MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY PARTICIPANT RESPONSIBLE FOR THE ATTEMPT, AND SPONSOR, MLB AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

12. BINGO ADMINISTRATION. Sponsor will be responsible for resolving any disputes and rules violations that arise in connection with Bingo. All decisions by Sponsor regarding Bingo shall be final and binding in all respects.

13. LIMITATION OF LIABILITY. Released Parties assume no responsibility or liability for (a) any incorrect or inaccurate registration or entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of Bingo; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of Bingo; (d) inaccessibility or unavailability of the Internet, the Application, or any combination thereof; or (e) any injury or damage to participant's or to any other person's computer or mobile device which may be related to or resulting from any attempt to participate in Bingo or download any materials in Bingo. If, for any reason, Bingo is not capable of running as planned for reasons which may include, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of Bingo, then Sponsor and MLB reserve the right at their sole discretion to cancel, terminate, modify or suspend Bingo in whole or in part.

14. USE OF INFORMATION. Personally identifiable information that is submitted by entrants, as part of Bingo, will be used to administer Bingo, select the Prize winners and fulfill the Prizes.

15. WINNERS' LIST. A record of the winners and the odds of winning will be kept on file by Sponsor for a period of one (1) year following the last game played at T-Mobile Park during the 2024 regular season.
